Should I file directly in Turkey or through the Madrid System?
Both work; the choice depends on how many countries you need. For three or fewer countries, direct national filings are usually cheaper and faster. For four or more countries that include Turkey, the Madrid System is more cost-effective per jurisdiction. We model both for your specific portfolio. A Chinese company can file Madrid via the China National Intellectual Property Administration (CNIPA), extending into Turkey as a designated state.
What is the official Turkish trademark fee?
Official Turkpatent fees for a single class application run roughly USD 80 to 150 (TRY equivalent, updated annually). Each additional class adds a similar amount. Attorney service fees run separately, typically USD 250 to 600 per single-class filing depending on complexity. We provide a written quote covering both before any filing.
Can I cover my brand across all 45 Nice classes?
Yes, but it almost never makes commercial sense. Filing across all 45 classes for one mark would cost more than USD 5,000 in official fees alone and creates non-use cancellation exposure within five years for classes you do not actually trade in. We help you identify the 2 to 6 classes that actually protect your business and add a small defensive layer in adjacent classes where useful.
What if someone has already registered my trademark in Turkey?
Three options: (1) opposition or revocation action through your Turkish IP attorney if filed in bad faith or unused for over five years; (2) coexistence negotiation; (3) buy-back. The right path depends on the squatter profile and the trademark value. We assess the situation and brief you in writing before any approach. Most cases resolve within 6 to 18 months.
